Supreme Court reinstates House of Representatives
February 23, Kathmandu: The Supreme Court has given a verdict to reinstate the dissolved House of Representatives.
The Constitutional Bench led by chief justice Cholendra Shamsher Junga Bahadur Rana including justices Bishowmbhar Prasad Shrestha, Anil Kumar Sinha, Sapan Pradhan Malla and Tej Bahadur KC has decided to reinstate the House of Representatives dissolved by the president following the recommendation of PM KP Sharma Oli.
Reading out the apex court’s verdict, Chief Justice Rana also said that a mandamus has also been issued in the name of the government to summon the session of the parliament within 13 days.
President Bidhya Devi Bhandair had dissolved the House on the 20th of December 2020 following the recommendation from PM KP Sharma Oli declaring the snap elections on the 30th of April and 10th of May.
Thirteen different writs were filed in the Supreme Court against the dissolution of the house and the court had been deliberating on the case since the 23rd of December 2020.
The Attorney General, attorneys and private lawyers had pleaded on behalf of the PM and the law professionals had pleaded on behalf of writ petitioners. Following the pleading from the petitioners and government’s sides, five members of Amicus Curiae had deliberated in the case.
