Kathmandu: The government has decided to advance the ‘search and recovery’ in the areas affected by the Bhotekoshi flood. <\/p>\n\n\n\n

The decision was made during the 37th executive committee meeting of the National Disaster Risk Reduction and Management (NDRRMA) held at the Ministry of Home Affairs in Singha Durbar. The meeting was chaired by Home Minister Sudhan Gurung. <\/p>\n\n\n\n

The meeting made an in-depth review of the search and rescue, relief and arrangements of relief camps. Executive Chief of NDRRMA, Dr. Dharma Raj Uprety, made it clear that search operations are still going on. <\/p>\n\n\n\n

“We are continuing the search; the search for the missing ones is still underway in two tunnel sites. However, in case of rescue, we have entered a new phase of work on rehabilitation and recovery.” <\/p>\n\n\n\n

According to Dr Uprety, scientific method is applied at scale for forensic test so that it would help identify the badly maimed bodies of those who perished in the floods. DNA testing processes for a total of 3,685 forensic samples were underway in two forensic laboratories. <\/p>\n\n\n\n

According to the Home Ministry, 1,957 samples were received for testing at the Nepal Police Central Forensics Laboratory at Samakhusi, Kathmandu, and 1,728 samples at the National Forensic Laboratory. International expert teams are extending support for the scientific examination and identification of bodies and remains. <\/p>\n\n\n\n

The NDRRMA data showed 5,285 people are still unaccounted for since the devastative floods. A total of 1,454 bodies and human remains have been retrieved while only 112 are identified. <\/p>\n\n\n\n

Total 1,292 bodies have been safely managed underground. With likelihood of rescuing survivors has diminished over time, the government has decided to shift its focus and resources toward search and recovery operations. <\/p>\n\n\n\n

The meeting also reviewed legal hurdles on distribution of minimum monetary relief to the families of the deceased. According to Clause 40 of National Civil Code, 2074 BS, there is a legal provision that a person is considered dead under normal circumstances only if s\/he has been missing continuously for 12 years without any information. <\/p>\n\n\n\n

However, the same code allows for judicial declaration of death under special circumstances and age: five years after a person reaching 80 years of age is missing, four years after a soldier deployed in a war is missing after the war ends, and three years after the date of an accident of plane, ship, or vehicle.<\/p>\n\n\n\n

Even if such a declaration is made by the court, it can be annulled if the person returns alive. <\/p>\n\n\n\n

Additionally, Rule 17 of the National Identity Card and Registration Regulations, 2077, mandates that no local registrar can record an incident without certification from the official body if a person is missing or a relationship is established. <\/p>\n\n\n\n

Due to these long procedures and restrictions stipulated in the current law, the executive committee has decided to provide a special administrative solution so that affected families are not immediately deprived of relief and social security. <\/p>\n\n\n\n

Accordingly, the concerned local governments, where the permanent addresses of citizens missing in the flood are located, will certify detailed information and send it to the respective District Administration Offices.<\/p>\n\n\n\n

Then, the District Administration Office will re-certify this information and forward it to the National Disaster Risk Reduction and Management Authority. After receiving this information, the Authority, according to the special procedures it has set, will take steps to provide relief and proceed with other legal processes for the families of the missing citizens. <\/p>\n\n\n\n

Similarly, the meeting also decided to immediately move forward with work related to temporary housing, reconstruction, and rehabilitation for citizens who lost their homes due to the flood. <\/p>\n\n\n\n

According to the information received so far, 278 families from seven local government units have reported that they want to immediately stay in temporary shelters. <\/p>\n\n\n\n

Besides this, 400 families from Gosaikunda Rural Municipality in Rasuwa and 350 displaced families from Uttargaya and other rural municipalities are currently taking shelter in Bidur Municipality of Nuwakot, so the final details of their choice of options are still pending.<\/p>\n\n\n\n
